United Nations Human Rights Committee Requests Information on United States Violations of Sexual and Reproductive Rights

[NEW YORK, NY] – Today, the UN Human Rights Committee (HRC) challenged the United States’s restrictive abortion policies as potential violations of the International Covenant on Civil and Political Rights (ICCPR) in its list of issues prior to submission of the fifth periodic report of the United States. The Global Justice Center (GJC) commends the HRC for asking the US to provide information on the impact of the reinstatement of the Global Gag Rule on women's rights under the ICCPR, including to non-discrimination and equal protection under Article 2, 3 and 26, the right to life in Article 6 and the right to be free from torture and other cruel, inhuman or degrading treatment or punishment under Article 7.

US Abortion Restrictions Violate Women’s Human Rights

Every year, 25 million women across the world are forced to obtain unsafe abortions. The United States, through its foreign policy, is deeply complicit in the violation of these women’s right to life and equality under international law.

International human-rights frameworks guard against these violations and hold the US and other countries accountable. The International Covenant for Civil and Political Rights (ICCPR), for instance, details the basic rights and freedoms guaranteed to all people worldwide, including the right to life, the right to liberty and the right to equality. Such rights are not symbolic: they are grounded in the dignity of each human being and protected by international law.

Since 1966, 172 parties — including the US — have signed the ICCPR. It is one of the few human-rights treaties that the US has ratified. But today, the US imposes illegal abortion policies that brazenly violated its obligations under the Covenant and other binding provisions of international law.

International Law Demands the U.S. Do Better on Abortion Policy

Within days of assuming office in 2017, President Trump re-instated and expanded the Global Gag Rule, which restricts funding for international organizations that provide or “promote” abortions. Two years later, feminist lawmakers serving in the now Democratic-led House kicked off their own terms by attempting to roll it back.

Pending legislation to establish a budget and keep the government open beyond the three week negotiation period includes a provision that would protect NGOs from being categorically defunded, effectively rescinding the Global Gag Rule. The House spending bill would render health and medical services of such organizations, including counseling and referral services, as insufficient for the sole basis for ineligibility for U.S. funding, and allow NGOs to use non-U.S. funding with fewer regulations.

Every Republican president since Ronald Reagan has enacted some version of the Global Gag Rule, but Trump drastically expanded its scope—and magnitude of harm. NGOs receiving U.S. foreign aid are now prohibited from spending any of their funds, including funding from non-U.S. sources, on abortion-related services, referrals, counseling or advocacy. Trump’s iteration of the Global Gag Rule also applies to all U.S. global health assistance, as opposed to previous version which were centered solely on U.S. family planning funds, meaning it affects $8.8 billion of foreign aid rather than $575 million.

Censorship Exported: The Impact of Trump’s Global Gag Rule on the Freedom of Speech and Association

Joint policy brief by the Global Justice Center and the Center for Health and Gender Equality (CHANGE)

In January 2017, President Trump signed a presidential memorandum reinstating the Global Gag Rule (GGR), an onerous policy that not only limits the provision of abortion services as a method of family planning but also restricts a wide variety of speech about abortion, including information, certain types of research, and advocacy. 

Two years on, the detrimental impacts of Trump’s GGR on sexual and reproductive health, HIV and AIDS services, and maternal mortality are well documented. But the GGR, in conjunction with other US abortion restrictions on foreign aid, also violates the fundamental rights of individuals and organizations to free speech and association. This policy brief looks at the documented impacts of the GGR that have been observed over the past two years against the human rights framework protecting the fundamental freedoms of speech and association. This is an edited version of GJC and CHANGE’s submission to the Human Rights Committee’s 125th Session for the preparation of the US List of Issues Prior to Reporting.

Justice for Queer Iraqis is Not Optional

Daesh’s crimes against queer Iraqis (or people perceived of being queer, or not sufficiently adhering to traditional gender norms) have been well-documented, including harassment campaigns, arbitrary executions, and forced disappearances. These crimes were also a tactic for building popular support for Daesh’s rule.

Since the UN voted last year to create an international team to investigate crimes Daesh committed in Iraq, human rights advocates including the Global Justice Center have called repeatedly for the team to follow international laws and standards as they investigate all crimes, not just those of terrorism. Earlier this year, GJC published its analysis of Iraq’s national laws, which are woefully insufficient for achieving justice for victims of genocide, crimes against humanity, and gender-based violence. If Daesh crimes are going to be prosecuted in domestic Iraqi courts, there is a very real danger that these venues will shut out LGBTQ Iraqis from seeking justice.

But Daesh isn’t the only group responsible for violence against LGBTQ Iraqis. A report published earlier this year by IraQueer found that 96% of LGBTQ respondents in Iraq have faced some form of violence over the past three years, and there have been documented killing campaigns against queer people in Iraq every year since 2003—well before the arrival of Daesh. The Iraqi government has completely failed to protect its queer citizens from harassment and violence; even worse, state forces have been active participants in targeted anti-LGBTQ violence alongside conservative militias. 

If the international community really is committed to justice, it must ensure not only that queer voices are included in Daesh prosecutions, but also that the Iraqi government is held to its obligations under human rights treaties like the Convention Against Torture and the International Covenant on Civil and Political Rights. Now is the time to take action to prove that justice for queer people is not optional.

Five Countries Directly Challenge US Abortion Restrictions at Universal Periodic Review

Today, during the Universal Periodic Review of United States, several member states of the UN Human Rights Council made statements condemning the anti-abortion restrictions that the US places on foreign aid, such as the Helms Amendment.

The UN Human Rights Council is responsible for monitoring the human rights records of the member states; every four years each country is reviewed and presented with recommendations on how to comply with their human rights duties.

The effects of Helms are can be seen in conflict zones around the world, most recently with the rescue of 214 pregnant Nigerian women from Boko Haram. The issue of comprehensive medical care has gained traction in recent months. As a result, today the Netherlands, United Kingdom, Norway, Belgium and France orally recommended that the United States work to ensure access to safe abortions around the world and limit the negative impact of the Helms Amendment.

War rape is an illegal tactic of war, constituting torture or genocide, and denial of medical care allows the perpetuation of those crimes. The constraints of the Helms Amendment deny women and children access to safe abortions, and restrict aid agencies from even providing information about abortion services.

In September 2014, the Global Justice Center submitted a report to the UPR, highlighting the ways in which constraints against women’s reproductive rights are incompatible with the Convention against Torture and the International Covenant on Civil and Political Rights. In April 2015, GJC traveled throughout Europe advocating for countries to use the UPR process to question the current anti-abortion restrictions the US imposes.

In addition to the five oral questions, written recommendations were also submitted, requiring a response and justification, should the United States continue to uphold the Helms Amendment. The US government has three months to formulate a response. It is clear that the Obama Administration has a responsibility and urgent duty to remedy these violations.

Historic Opportunity for Women of South Sudan

GJC provides Critical Expertise to Ensure South Sudan’s New Constitution Embeds Internationally Guaranteed Equality Rights.

The Republic of South Sudan is in the process of drafting a new constitution and democracy advocates and women’s groups are hoping to create a new paradigm of democracy, justice, and equality in Africa that will be adopted when the region declares independence on July 9, 2011.

The Global Justice Center, due to its extensive experience in constitution analyes in Iraq, Kurdistan, Burma, and Northern Ireland, was asked by one of South Sudan’s leading women’s organizations for its expertise on implementing women’s rights in the Draft Transitional Constitution.  Because the GJC is dedicated to forging and enforcing international law grounded on gender equality, the recommendations that were made on the South Sudanese draft constitution naturally reflected these principals, ensuring primacy for International Humanitarian Law (IHL) and equality guarantees.  With the ratification of this new constitution, South Sudan has the historic opportunity to remodel their government on a foundation of parity and power that promotes equality and peace.

In particular, the GJC’s analysis carefully scrutinized every article in order to ensure compliance with international treaties such as the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) and the International Covenant on Civil and Political Rights (ICCPR).

GJC believes that the structure and inherent permanence of constitutions to be a critical component in efforts to create justice and equality, by establishing a concrete basis upon which all law and policy will be developed going forward.  Amongst many crucial suggestions, the GJC recommended that:

1.  Equality for women must be explicitly defined to ensure that women have gender parity in positions of power.

2.  The government has an obligation to take permanent steps to ensure that all treaty guarantee laws are implemented.

3.  In accordance with the ICCPR and the African Protocol, which are both applicable to South Sudan as a successor state, there exist quotas for a starting point of 30% women in the legislative and executive branches as well as gender parity in the judiciary branch and new constitutional court.

4.  Adding an article modeled after the South African Constitution explicit on reproductive rights.

The Republic of South Sudan’s new constitution has the ability to address the suffering caused by Sudan’s civil war and mark a crucial turning point in women’s ability to access equality.

The GJC advocates for the enforcement of law over the creation of policy as the strongest avenue to effectively implement human rights.  As GJC President Janet Benshoof states, “The constitution is the most important legal instrument, for it is the single time for women to influence peace and justice as well as place equality over conflict and peace over security.”
